Terms of Service

■ Article 1 (Purpose)

These terms aim to define the rights, obligations, and responsibilities between members (and non-members) and site operators in using the image generation, posting, sharing, and community services (including comments and bulletin boards) provided by AICKYWAY (hereinafter referred to as the "Site") utilizing generative AI.

These terms shall be interpreted in accordance with relevant laws and customs, and matters not specified shall be governed by the general laws of the Republic of Korea.

■ Article 2 (Definition of Terms)

1. Member: A person who has registered with the Site in accordance with these terms and uses the services.

2. Non-member: A person who uses the services provided by the Site without registering.

3. Content: Images, posts, comments, and other materials created, posted, and shared by members within the Site.

4. Service: Image generation, posting, sharing, community (bulletin board, comments, etc.) functions and other additional services provided by the Site.

■ Article 3 (Effect and Amendment of Terms)

1. These terms shall be effective for all members and non-members who wish to use the services.

2. By agreeing to the "Terms of Service" during registration, you are deemed to have agreed to all contents of these terms.

3. The Site may amend these terms within the scope that does not violate relevant laws, and the amended terms shall be announced through notices or postings on the Site and shall be effective 7 days after posting.

4. Members who do not agree to the amended terms may discontinue using the service and request withdrawal (or termination of use agreement).

■ Article 4 (Registration and Membership)

1. Those wishing to register shall fill in member information according to the registration form set by the Site and apply for registration by clicking the "Sign Up" button.

2. The Site may refuse registration applications or restrict or revoke membership of already registered members in the following cases:

• ① If the registration information contains false information, omissions, or errors
• ② If using multiple accounts
• ③ If deemed to interfere with the smooth operation of the Site

3. The membership agreement is established when member registration is completed on the Site.

4. If violations are discovered after registration, the Site may restrict, suspend, or revoke the member's membership, in which case the member cannot claim any rights related to service use.

■ Article 5 (Provision and Modification of Services)

1. The Site provides members with the following services:

• ① Image generation service using generative AI
• ② Services for posting, sharing generated images, and community (post writing, comments, bulletin boards, etc.)
• ③ Other additional services developed or provided by the Site

2. The Site may change the content and method of service provision, and shall notify members as prescribed in Article 8 when making changes.

■ Article 6 (Service Interruption)

1. The Site may temporarily suspend service provision in case of unavoidable circumstances such as system maintenance, inspection, urgent failures, or communication disruption.

2. In such cases, the Site shall notify members as much as possible in advance (or afterwards). However, post-notification is possible in unpredictable emergency situations.

■ Article 7 (Withdrawal and Membership Revocation)

1. Members may request withdrawal from the Site at any time, and the Site shall process the withdrawal procedure according to the relevant privacy policy.

2. If a member engages in any of the following acts, the Site may restrict, suspend, or revoke the member's membership:

• ① Acts violating the terms of service or announcements and operating regulations within the Site
• ② Acts infringing on the rights or defaming others
• ③ Registering through fraudulent means such as using multiple accounts
• ④ Other cases causing serious interference with the smooth operation of the Site

3. Even after withdrawal, posted posts and comments will not be deleted, and if deletion is desired, the member must request deletion directly.

■ Article 8 (Notification to Members)

1. The Site may provide individual notifications to members through the email address provided during registration.

2. Notifications to an unspecified number of members may be substituted for individual notifications by posting on the Site's notices.

■ Article 9 (Personal Information Protection)

1. The Site strives to protect members' personal information in accordance with the "Personal Information Protection Act" and other relevant laws, and collects, uses, and stores personal information according to the privacy policy.

2. Members are deemed to have consented to providing personal information when using the service.

■ Article 10 (Site Obligations)

1. The Site strives to provide stable and continuous service to members in accordance with relevant laws and these terms.

2. The Site is responsible for protecting members' personal information and posts, and does not send commercial advertising emails that members do not want.

■ Article 11 (Member Obligations and Prohibited Acts)

Members shall not engage in the following acts:

1. Acts violating these terms, Site announcements, and operating regulations

2. Acts stealing or infringing on others' personal information, IDs, or passwords

3. Acts infringing on others' reputation or intellectual property rights such as copyrights

4. Creating or transmitting posts with illegal, obscene, or violent content

5. Transmitting advertising information to unspecified masses such as spam or junk mail

6. Acts putting strain on the system to interfere with the normal operation of the Site

7. Other acts that violate relevant laws or are deemed inappropriate by the Site

All legal and civil/criminal responsibilities arising from the above acts are with the relevant member.

■ Article 12 (Post Management and Copyright)

1. The copyright of all posts (posts, comments, etc.) created and posted by members within the service belongs to the author of the post. However, the Site may use members' posts free of charge within a reasonable scope for service operation, exhibition, transmission, distribution, and promotion purposes.

2. The Site may temporarily block, delete, or move posts falling under the following categories without prior notice, and may restrict, suspend, or revoke the membership of the relevant member if necessary:

• ① Posts violating these terms and Site regulations
• ② Posts infringing on others' rights
• ③ Posts related to criminal acts or against public morals

3. Disputes related to posts are the responsibility of the member who wrote the post, and the Site is not separately liable.

■ Article 13 (Advertising and Information Provision)

1. The Site may post advertisements for service provision or benefit information purposes.

2. Members acknowledge that the Site is not responsible for damages caused by advertisements or promotional information posted on the Site.

■ Article 14 (AdSense Policy Compliance)

The Site may use third-party advertising services including Google AdSense, and all members must comply with the following advertising policies when posting content on the Site. Violations may result in restricted advertising or content deletion.

• Copyright: While the copyright of AI-generated images generally belongs to the creator, images generated by clearly imitating specific famous characters, logos, or brands are prohibited from posting due to potential trademark and copyright infringement.
• Auto-generated Content: Google prohibits posting low-quality auto-generated content. When posting AI-generated text or images, members are responsible for directly reviewing and editing to ensure information accuracy and content quality. Meaningless lists or low-quality content may be sanctioned.
• Prohibited Content: The following types of content cannot have ads placed and are prohibited from posting on the Site:
  • Adult or explicit sexual content
  • Violent or hate-promoting content
  • Manipulated images such as deepfakes that may mislead others or defame reputation
• Privacy Policy: The Site operates a separate Privacy Policy page according to Google AdSense requirements, and all members must comply with this policy.

■ Article 15 (Community Guidelines)

AICKYWAY aims to be a community where all members can engage in safe and creative activities. The following guidelines apply to all content (images, text, comments, etc.) within the Site, and service use may be restricted for violations. (Effective: 2025-09-01)

1. Basic Principles

Respect, Safety, Legality, Qualityare the core principles of our community. Please strive to respect others, create a safe environment, comply with laws, and share high-quality content.

2. Creative Works and AI Generation Labeling

• Members must clearly distinguish whether the content they post is their own creation or AI-generated.
• For AI-generated content, we recommend providing as much detail as possible about the AI model used, checkpoint, main prompts, or references.
• When creating content using others' copyrighted works, trademarks, or characters, you must comply with the original copyright holder's policies and clearly indicate licenses and sources when necessary.

3. Prohibited Content

The creation, posting, sharing, and linking of content falling under the following categories is strictly prohibited:

1. Sexual/Explicit Content:
   Content depicting or implying excessive body exposure or sexual acts / Content expressing fetishes (bondage, SM, etc.) / Promotion or implication of adult products or prostitution services / (Serious violation) All content sexually depicting minors or subjects clearly recognizable as minors (real, virtual, 2D/3D alike)
2. Violence and Dangerous Acts:
   Excessively cruel or violent content / Content glorifying or promoting self-harm, suicide, or acts causing serious physical harm to oneself or others / Animal abuse content
3. Illegal Activities:
   Content promoting or instructing clear criminal activities such as drugs, illegal weapons trade, hacking, or personal information sales
4. Discrimination, Hate, Harassment:
   Personal attacks, profanity, or sexual harassment targeting specific individuals or groups / Discrimination and hate speech based on race, nationality, religion, gender, sexual orientation, disability, etc. / Acts causing mental distress such as stalking, threats, or bullying
5. Privacy Violations:
   Disclosing personally identifiable information (name, contact, address, accounts, etc.) without consent (doxing) / Recording, filming, or distributing private conversations or private life without consent
6. Intellectual Property Infringement:
   Unauthorized copying, distribution, or transmission of others' works / Impersonating or commercially misusing others' trademarks or brands
7. Spam, Fraud, Malicious Acts:
   Repeatedly posting the same content (flooding) / Distributing links (phishing) that deceive users into clicking or files containing malicious code
8. Misinformation:
   False medical or legal advice that could pose serious threats to life, health, safety, or property

※ Even if not covered by the above items, content may be sanctioned if deemed harmful to the community by the operators.

4. Restricted (Caution) Content

The following content may have restricted public exposure, recommendations, or advertising within the service:

• News-purpose content containing realistic violence or accident scenes (however, sufficient context explanation and warning text must be included)
• Controversial content on sensitive topics such as politics, religion, or social disasters
• Excessively low-quality, duplicate, or meaningless AI-generated content

5. Post, Tag, and Profile Rules

• Using sensational or violent expressions in post titles, thumbnails, or tags to mislead users is prohibited.
• Tag spamming - indiscriminately using keywords or hashtags unrelated to the content to pollute search results - is prohibited.
• Using accounts, profile images, or nicknames that impersonate other individuals or organizations is prohibited.

6. Reporting, Appeals, and Rights Violation Response

• Reporting: If you find content violating community guidelines, you can report it through the "Report" button on each content or via email (e.g., [email protected]).
• Processing: Reported content will in principle be reviewed and initially addressed within 72 business hours.
• Rights Violation: For content infringing on your rights such as copyright, if you request deletion with documents proving you are the rights holder, it will be processed promptly and reposting of the content will be restricted.
• Appeals: If you do not agree with the operator's action, you may file an appeal in writing or by email within 7 days of receiving the action notice. The Site will notify you of the result after review.

7. Sanctions

The following progressive sanctions may be applied for guideline violations:

1. 1st Violation: Warning and guideline guidance
2. 2nd Violation: Deletion or hiding of relevant content, restriction of some functions (upload, comment writing, etc.)
3. 3rd Violation: 7 to 30 days account suspension
4. 4th Violation (Permanent Ban): Permanent account suspension and blocking re-registration through related information (IP, device information, etc.)

※ However, for serious violations such as creating/distributing sexual content targeting minors or promoting crimes, immediate permanent suspension may be taken without prior warning.

8. Advertising and Monetization

• Advertising placement follows the policies of the platform and advertising partners first.
• Content included in or potentially mistaken for prohibited/restricted items in these guidelines may have restricted advertising.

9. Transparency of Operation

The Site strives for transparent operation by regularly disclosing major revision history of community guidelines and statistics on actions taken against violating content.

■ Article 16 (Jurisdiction and Governing Law)

1. In case of disputes related to these terms and service use, the laws of the Republic of Korea shall apply, and disputes shall be filed with the court having jurisdiction under the Civil Procedure Act.

2. Disputes between members and the Site shall prioritize amicable settlement, and if settlement cannot be reached, the jurisdictional court shall apply.
